If at any time a staff member determines that a guest’s actions may compromise the safety of others or the crew, we reserve the right to immediately end the ride—whether private or public.

In such cases:

We will return to port promptly.
If necessary, we may contact the appropriate authorities.

Your cooperation helps ensure a safe environment for everyone.

📸 Respect for Privacy

Please be considerate when taking photos or videos.

Do not photograph or record other guests without their explicit consent.
Some individuals may prefer not to appear in any media.

This courtesy helps maintain a respectful and comfortable atmosphere for all.

We encourage open, respectful communication among all guests.

🪧 General Boat Rules

All guests must wear a life jacket at all times.
No vest = no ride.
No riders under 5 years old.

🪧 Snorkeling / Water Scooter Diving Rules

No snorkelers or divers under 12 years old.
Mandatory safety briefing before entering the water.
All participants must listen and pay attention — no exceptions.
Stay within the marked snorkeling zone.
🚩 Do not swim toward other boats.
No diving or jumping from the boat.
Use the designated ladder or platform.
Do not touch coral or marine life.
🐠 Look, don’t touch.
Snorkeling time limit: 20 minutes per session.
Follow crew instructions for re-boarding.
Signal the crew immediately if you need help.
🙋 Stay calm and use hand signals.
No entering the water under the influence of alcohol or drugs.

🪧 Tow Riding Rules

Hold on tight — and let go if you fall.
✋ Always use the correct hand signals.
Follow crew instructions at all times.
Stay seated or in the proper riding position.
No standing or reckless movement.
No tow riding after consuming alcohol.

Do not attempt tricks or stunts.
⚠️ They can be dangerous to you and others.
Children must meet all age requirements.
A guardian must be present at all times.
No tow riders under 5 years old. No exceptions.

Each passenger must submit a completed waiver before boarding. Failure to submit the waiver will result in the forfeiture of all payments. The tour will be considered non-refundable, and you will not be eligible for rebooking.

IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING.

By signing this Waiver and Release of Liability, I agree to the terms outlined below and acknowledge that you understand and accept the inherent risks associated with participating in any activity offered by Dominion Fishing and Charter Company. This includes, but is not limited to, fishing charters, boating, water activities, and any related services.

1. Assumption of Risk
I, the undersigned, acknowledge that engaging in fishing, boating, and water-based activities involves inherent risks, including but not limited to: slipping, falling, drowning, boat accidents, exposure to the elements, and any other unforeseen incidents. I voluntarily assume all risks associated with participating in these activities.

2. Release of Liability
I, on behalf of myself, my heirs, executors, and assigns, hereby release and forever discharge Dominion Fishing and Charter Company, its owners, employees, agents, contractors, and affiliates from any and all claims, demands, actions, liabilities, losses, damages, costs, or expenses arising out of or related to any injury, accident, or damage occurring during my participation in any activity with the Company. This includes, but is not limited to, claims for personal injury, property damage, or loss of life.

3. Indemnification
I agree to indemnify, defend, and hold harmless Dominion Fishing and Charter Company, its employees, agents, and representatives from any claims, demands, or actions brought against them arising from my actions or the actions of any party under my supervision while onboard.

4. Parental Consent and Chaperone Requirement for Minors
If the participant is under the age of 18, a parent or legal guardian must provide written consent below and be present as a chaperone during the trip. The chaperone will be responsible for the child’s behavior and safety during the trip. I confirm that I have parental or legal guardian consent for any minor traveling with me and will assume full responsibility for their safety and well-being while onboard.

5. Medical Treatment
In the event of an emergency, I consent to any medical treatment that may be necessary in the event of injury or illness. I understand that I am solely responsible for any medical expenses incurred as a result of such treatment.

6. Governing Law
This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of St. Vincent and the Grenadines, and any disputes arising from this Waiver shall be resolved within the jurisdiction of St. Vincent and the Grenadines.

7. Acknowledgment of Understanding
I confirm that I have read and understood this Waiver and Release of Liability, and that I am signing it voluntarily and with full knowledge of its contents. I acknowledge that I am waiving certain legal rights, including the right to file a lawsuit.
